13.03.2025 rc/ct.no.34 Item No.43 CRR No. 334 of 2025 In the matter of : Sri Sukumar Dutta .......Petitioner Mr. Manisankar Chattopadhyay ...for the Petitioner The petitioner has assailed the order dated September 12, 2022 passed by the learned Additional Chief Judicial Magistrate-I, Calcutta in G.R.Case No. 597 of 2019 directing issuance of warrant of arrest against him.

It appears that the petitioner was initially on bail and failed to appear before the learned Magistrate on September 12, 2022 for which warrant of arrest was issued against him. The petitioner undertakes to surrender before the learned Magistrate within ten days from date. If the petitioner surrenders before the learned trial Court within ten days from date and files an application for bail, the learned Magistrate shall deal with the same in accordance with law.

In the event the petitioner fails to surrender before the learned trial Magistrate within the stipulated time frame, the learned trial Magistrate shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court.

The warrant of arrest issued vide an order order dated September 12, 2022 passed by the learned Additional Chief

Judicial Magistrate-I, Calcutta in G.R.Case No. 597 of 2019 be stayed till March 24, 2025.

CRR No. 334 of 2025 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
