REJECTED C.R.M.(A) 240 of 2024 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Hili Police Station Case No. 163 of 2022 dated 11.07.2022 under Section 21 ©/22©/23©/27A of the Narcotic Drugs and Psychotropic Substances Act read with 341/353/34 of the Indian Penal Code.
And In Re : Minarul Mandal ...... petitioner Ms. Busra Khatoon ...for the petitioner Mr. Ranadeb Sengupta ...for the State Commercial quantity of narcotic was seized from the coaccused. Local persons saw the Border Security Force chasing the petitioner at the place and time of occurrence. In such circumstances, complicity of the petitioner in the incident cannot be overlooked.
We are of the view that the petitioner is unable to overcome the restriction under Section 37 of the N.D.P.S. Act, 1985.
Consequently, we are unable to grant anticipatory bail to the petitioner and the prayer for bail of the petitioner is rejected.
