A transcript copy of the mobile phone of the victim girl containing exchange of messages with the accused of about 300 pages has been filed before this Court and the same is taken on record.

A copy of the same has been handed over to the investigating officer. The same may be considered by the investigating officer in accordance with law. It appears that the orders of this Court dated 20th January, 2023 and 24th January, 2023 were carried in appeal before a Division Bench in MAT 123 of 2023, which is disposed of by a judgement and order dated 6th February, 2023. A copy of the aforesaid judgement dated 6th February, 2023 is taken on record.

The orders of this Court have not been interfered with except granting liberty to the accused to apply for bail in the event he surrenders.

It is submitted that the accused has surrendered on 9th February, 2023 and he is now in custody.

It is expected that the investigation is carried out as expeditiously as possible and report in the final form may be submitted before the concerned judicial magistrate within fifteen days from date.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

The report of the Officer-in-Charge, Contai Women Police Satition, Purba Medinipur dated 21st February, 2023 is taken on record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
