The grievance of the petitioner is that the petitioner's application for transfer dated 11th March, 2020 on the ground of ailments, vacancy, and other inconveniences has not yet been considered by the respondent no. 5.

Learned Counsel appearing for the Council submits that transfer is not a matter of right, but only if any vacancy arises in any school.

In reply, Mr. Biswas submits that there are vacancies in some schools under the same circle as per vacancy status of the respondent Council.

Upon hearing the learned Counsel appearing for the respective parties and upon considering the materials on record, the writ petition is disposed of by directing the respondent no.

to consider the petitioner's representation dated 11th March, 2020 upon granting an

opportunity of hearing to the petitioner and to take a decision in accordance with law and to communicate the same to the petitioner.

The above exercise shall be completed by the respondent no. 5 within a period of six weeks from the date of communication of this order along with a copy of the writ petition.

There shall, however, be no order as to costs. The parties shall act in terms of the copy of the order downloaded from the official website of this Court. (Rajarshi Bharadwaj, J.)
