Sardar Mr. Prashant Pathak.....for the appellants Mr. Avishek Sinha ...for the State The learned advocate for the appellants submits that they will pay the fine of Rs. 1000/- as directed by the order dated 18.12.2003 passed by the learned Additional Sessions Judge, 3rd Court, Howrah in Sessions Trial No. XII (April) 2001 for commission of offence punishable under Section 148 of the Indian Penal Code and also to pay further amount of Rs. 1000/- against the commission of offence punishable under sections 149/323 of the Indian Penal Code. The prayer of the appellants is allowed.

The appellants are directed to submit the amount to be payable as fine before the learned trial court and to withdraw the instant appeal.

The lower court record is to be sent back to the learned trial court.

The amount of fine in connection with the order 18.12.2003 passed by the learned Additional Sessions Judge, 3rd Court, Howrah is to be deposited by 19th June, 2023.

The appeal is accordingly, disposed of.

Let a copy of this order be communicated to the department immediately in order to transmit the LCR to the concerned trial court.
