The petitioner's prayer for transfer on medical ground is pending consideration at the end of the District Magistrate, Malda for a considerable period of time.
The application of the petitioner appears to have been recommended by the Executive Officer, Habibpur Panchayat Samity.
Without entering into the merit of the claim of the petitioner, as it appears that the prayer is pending consideration before the District Magistrate, accordingly, the instant writ petition is disposed of by directing the District Magistrate, Malda to consider the prayer of the petitioner for transfer in accordance with law, at the earliest but positively by 31st May, 2024. An opportunity of hearing may be provided to the petitioner to produce all documents in support of her
prayer for transfer. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
Learned advocate for the petitioner is directed to forward a copy of the application for transfer dated 21st September, 2021 along with supporting medical documents to the aforesaid respondent at the time of communicating the order of the Court.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
