1. The affidavit of service as filed is taken on record.

2. The petitioner no. 2 is a self financing college recognized by the University Grants Commission and other relevant bodies. The petitioner no. 1 organizes and manages the petitioner no. 2.

3. The petitioner no. 2 is aggrieved that even after a delay of more than one and half years, the counselling held sometime on January 20, 2026 has left them in the lurch, as no students have been allotted to the petitioner no. 2 from this round of counselling in January 2026.

4. The University is represented. Mr. Maiti, learned Advocate appearing for the respondent nos. 3 to 6, submits that since there are vacant seats, further rounds of counselling will be held and successful students will be admitted to the petitioner no. 2, which is a self financing college. If further rounds of

counselling are not held and the petitioner no. 2 is not allotted students, the petitioners will be prejudiced it presently it has 56 vacant seats.

5. Thus, if any further rounds of counselling are held and the petitioners are allotted students to occupy the vacant seats by March 15, 2026, the petitioners' grievance should stand redressed. However, if such counselling is not held or the petitioners are not allotted any students to the vacant seats, the petitioners will be at liberty to approach the University with a proposal of taking qualified students (JEMAS) for admission and registration by the University.

6. It is made clear that the students will not be admitted nor be able to attend classes without the sanction/permission of registration from the University. The University will consider the proposal of the petitioner no. 2 to admit such students and dispose it of within a period of seven days from making such proposal by the petitioners.

7. With these afore-stated directions, the writ petition is disposed of.

8. There shall, however, be no order as to costs.

9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
