29.01.2024 Dd allowed CRM(DB) No. 237 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Pursurah Police Station Case No. 04 of 2013 dated 16.01.2013 under Sections 399/402 of the Indian Penal Code , 1860 and adding Sections 25/27 of the Arms Act, 1959.

1. Petitioner was on bail earlier. Due to miscommunication he was unable to appear before the trial Court. Presently petitioner is in custody for 60 days. There is no possibility of trial concluding in near future.

2. Under such circumstances, we are inclined to grant bail to him.

3. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of Learned Additional Chief Judicial Magistrate, Arambagh, subject to condition that petitioner shall appear before the trial court on every date of hearing until further orders and

shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner shall meet the Investigating Officer of Pursurah Police Station once in a week until further orders.

4. In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
