Petitioner Mr. Arnab Chatterjee Mr. Chandan Mondal Ms. Ankusha Ghosh Ms. Debolina Roy ...for the petitioner Mr. Atif Ahmed Siddiqui ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. Apart from the statements of the co-accused, there is no other material available against the present petitioner. The principal accused was arrested and thereafter granted bail by this Court. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the petitioner was present there along with the principal accused. He managed to flee, as would be evident from the statements of a BSF personnel. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
