Apprehending arrest in connection with Haldia Police Station Case No.124 of 2019 dated 13.11.2019 under Sections 420/34 of the Indian Penal Code, 1860, the petitioner has filed the present application.

Heard the learned advocates appearing for the respective parties. Considering the materials in the case diary and bearing in mind the nature of accusations which pertain to commercial transaction and in view of the fact that co-accused persons similarly situated with the petitioner had already been granted anticipatory bail by a coordinate Bench of this Court, we are of the opinion that his custodial interrogation is not necessary. As such, his prayer for anticipatory bail is allowed.

Accordingly, in the event of arrest the petitioner, namely, Mukesh Tripathi shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the

arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 with a further condition that he shall cooperate with the investigation and meet with the Investigating Officer, as and when called for. The application for anticipatory bail, being CRM (A) 446 of 2022, is, thus, disposed of.
