Learned advocate appearing for the petitioner refers to the order passed on 25.11.2025 in CRM(NDPS) 1495 of 2025 and submits that presently the petitioner is in custody for more than 21⁄2 months. The petitioner has been implicated in the present case, according to the learned advocate, on the basis of statement of co accused and there has been no recovery from the possession of the present petitioner.
Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that there are four criminal cases already registered against the present petitioner. Two of the cases are under NDPS Act which is of the year 2018 and two of the cases are under the provisions of Arms Act and the Explosive
Substances Act along with the regular provisions of the Indian Penal Code.
Having considered that the complicity of the present petitioner is only on the basis of the statement of the co-accused, I am inclined to release the petitioner on bail but on stringent conditions because of previous conduct. There are two independent witnesses who have also named the petitioner for running such illegal business of contraband.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Jillar Mondal @ Hitlar Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District and Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the prior permission of the learned special court. Additionally, the petitioner shall till further orders of this Court once in every 10 days meet with the Inspectorin-Charge, Jalangi Police Station.
The Inspector-in-Charge, Jalangi Police Station once in a month will report before the learned special court regarding the compliance of the said conditions. Accordingly, CRM (NDPS) 168 of 2026 is allowed. Report submitted by the State be kept with the record.
