Petitioner is aggrieved by the mode and manner of investigation of Golabari Police Station Case No.1 of 2025. Petitioner alleges that the private respondents being the accused in the said case are aggressive, adamant and are still threatening after registration of the criminal case, as such, the petitioner and her family members who have suffered because of the illegal act and activities of the private respondents are feeling insecured and in spite of informing the police authorities, they are not assisted. Learned advocate for the State has submitted a report. According to the State, police authorities have taken steps for recording the statement of the

witnesses as also recorded the statement under Section 183 of the BNSS.

Learned advocate for the private respondents submits that there was a different chronology of events and the present petitioner has distorted facts to her own advantage. On the basis of the complaint of the private respondents also, a case has been registered by Golabari Police Station.

Be that as it may, the criminal court is already in seisin of both cases. So far as the insecurity of the petitioner before this Court is concerned, police authorities would, if an application is made before the learned Magistrate, assess the threat perception of the petitioner and her family members and take steps in accordance with Witnesses Protection Scheme, 2018. The police authorities would also keep a strict vigil and ensure that no breach of the peace takes place and/or further untoward incident results because of the inimical relationship existing between the parties. With the aforesaid observations, WPA 1724 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
