Mr. Sounak Bhattacharya, Mr. Sounak Mondal ...for the Petitioner Mr. Lalit Mohan Mahata, Mr. Himadri Kumar Mahata ...for the State The grievance of the petitioner is that a plot of land 23-02-2026 AKG Ct. 15 vested in the State, bearing L. R. Dag no 759, J.L. No. 97, Mouza-Alankarpur, District Purba Medinipur, measuring approximately 43 decimals, was partially allotted to the petitioner by way of a "patta" for 5 decimals. The petitioner alleges that the Panchayat has undertaken construction on the portion of the land allotted to him.

Learned counsel appearing for the State has filed a report. The report indicates that the remaining 38 decimals of Plot No. 759 were transferred in favour of Padima-II Gram Panchayat for the purpose of constructing a new Gram Panchayat office. According to the State, the construction work is being carried out on this 38-decimal portion.

It appears that, while the precise demarcation of the land is disputed, there is no dispute regarding ownership: 38 decimals belong to the Panchayat, and 5 decimals belong to the petitioner.

In view of the above, the Additional District

Magistrate, Purba Medinipur, is directed to demarcate the 5-decimal portion of Plot No. 759 belonging to the petitioner within one month from the date of communication of this order. The demarcation process shall be conducted after giving due notice to the petitioner. In respect of the remaining portion of the land, the respondents shall be at liberty to carry out construction of the Panchayat office in accordance with law.

Accordingly, WPA 1672 of 2026 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
