Bhaskar Prasad Vaisya, learned Additional Government Pleader files the instruction dated May 03, 2024 which he has received from the District Inspector of Schools (S.E), Howrah, the respondent no. 4 herein, let it be kept with the record.

It appears from the said instruction that to avail the benefit of the family pension, the petitioner is required to refund a sum of Rs.4,69,984/- (Rupees Four lakh Sixty Nine thousand Nine hundred Eighty four only).

The petitioner is directed to refund the said amount to the concerned Government Treasury within a period of two weeks from date, subject to such refund within the said time the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, the respondent no. 3

herein, shall take forward steps for issuance of necessary Pension Payment Order (PPO) and release the pension including the arrear pension in favour of the petitioner.

It is made clear that the PPO shall be issued with effect from the date following the date of death of the husband of the petitioner and the arrear pension shall be calculated accordingly. W.P.A. 1524 of 2024 is disposed of with the above terms without any order as to costs.
