Report submitted by the State encloses the statement as well as the communication made to the Officer-in-Chrage, Ekbalpore Police Station in connection with Ekbalpore Police Station Case No. 507 of 2021. Report reflects that charge has already been submitted under Sections 417/376 IPC.
In view of the report so submitted, I direct the learned CJM, Alipore to commit the case to the court of sessions on the next date so fixed. The learned Sessions Judge either himself or to a court so designated would immediately transfer the records of the case. The transferee court would frame charges within a period of thirty days of the receipt of the records against the petitioner and thereafter start the evidence within a fortnight thereof. The learned trial court would insist on examination of the complainant/victim as PW-1. Petitioner is granted liberty to approach this court after the examination-inchief and cross-examination of PW-1 is over. With the aforesaid observations, the revisional application being CRR 230 of 2023 is disposed of.
Pending applications, if any, are consequently disposed of.
