1. The report filed in the form of affidavit on behalf of the respondent nos. 1, 3 & 4 and the affidavitin-reply filed by the petitioner, are taken on record.

2. The petitioner's grievance is that in spite of being considered for promotion, the same had not been given to him, in view of his belated graduation results.

3. The concerned authority had categorically mentioned in its resolution that since the petitioner was yet to attain eligibility on account of his final result of B.A. Degree, his promotion would be considered upon attainment of the same. The petitioner states that he had obtained such eligibility sometime in October 2007.

4. Mr. Roy, learned Advocate appearing for the respondent nos. 1, 3 & 4, has filed a report in terms of the order of this Hon'ble Court and has in his usual method, raised the point of maintainability.

5. It is true that the present dispute is covered under the provisions of Section 102 of the West Bengal Cooperative Societies Act, 2006 and the petitioner is at liberty to institute a Dispute Case before the concerned Registrar.

6. In the event, the petitioner files such a dispute case, the concerned Registrar either by himself or through an authorized person, who will proceed to deal with the matter and dispose of the same within a period of six weeks from the date of issuance of summons.

7. With these afore-stated directions, WPA 1777 of 2025 is disposed of. No order as to costs.
