1. Affidavit of service filed in Court is taken on record.

2. The petitioner claims interest on delayed payment of terminal benefits. The petitioner superannuated from service of the WBTCL on December 31, 2019. He received his terminal benefits of Rs.24,88,552/- towards 1st installment of provident fund on 08.04.2020, Rs.16,76,107/- towards gratuity & leave encashment on 20.04.2020 and Rs.24,88,552/- towards 2nd installment of provident fund on 12.06.2020.

3. The petitioner is entitled to interest for the period from 01.01.2020 to 08.04.2020 at the rate of 6 per cent per annum towards 1st installment of provident fund and from 01.01.2020 to 20.04.2020 at the rate of 6 per cent per annum towards gratuity and leave encashment and from 01.01.2020 to 12.06.2020 at the rate of 6 per cent per annum towards 2 nd installment of provident fund. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

4. In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

5. The writ petition is disposed of.

6. There will be no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
