Mr. Mit Guha Goy Ms. Sneha Saha ...for the Petitioner Learned counsel for the petitioner submits that her client filed an application under section 12 of the Protection of Women from Domestic Violence Act, 2005 presently pending before learned Judicial Magistrate 5th Court, Alipore seeking relief under sections 18, 19,20, 22 23(1) of the Protection of Women from Domestic Violence Act. In the said proceeding, the petitioner also filed an application under section 23(2) of the said Act, for interim relief on 19.04.2025. Since then about one year has already passed but the court below has not yet disposed of the said application seeking interim relief till date. Therefore, she prayed for necessary direction upon the court below for expeditious disposal of the said application.

Having heard learned counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered that the application for interim relief is pending for more than one year, the instant application being CRR 326 of 2026 is hereby disposed of with a direction upon the court below to dispose of the said application filed by the petitioner under section 23(2) of the said Act, preferably within a period of one month from the next date of hearing.

This order is passed invoking this court's jurisdiction under section 529 of the BNS.
