(Via Video Conference) The instant writ petition was moved firstly on 15th January, 2009 and subsequently the said writ petition was taken on 27th January, 2009 and this Court passed direction upon the respondents to file affidavit-in-opposition within two weeks, reply thereto, if any within a week thereafter the matter was supposed to be listed in the monthly list of March, 2009. It appears from record, in spite of direction no affidavits have been filed. The matter was again listed on 23.11.2021, on the said date also none appeared on behalf of the petitioner and accordingly in the interest of justice, the case was adjourned till today. Today also none appeared on behalf of the petitioner. It reveals from record that the petitioner is not interested to proceed with the matter.

Hence, the writ petition being WPA 459 of 2009 is dismissed for default.
