Learned advocate for the State submits that the coaccused in the impugned judgment had been sentenced for a period of ten years. It is imperative to find whether the said co-accused Nuru @ Noor Mahammad Mondal had filed an appeal or not if the said accused had filed an appeal then the instant appeal should be heard by the Division Bench.
