It appears that after filing of application, the proposed shop-cum-godown was inspected, but since then the authority concerned has not taken any decision.

It appears that the petitioner has filed a representation to the authority. It was also not considered. It further appears that license was not issued in favour of anyone till today.

Thus, the writ petition appears to be a premature one. Hence, this writ petition stands dismissed with liberty to the petitioner to sue afresh on the self-same cause of action.

I have not entered into the merits of this matter, all points and are kept open to be decided on merits in accordance with law before the appropriate stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Subhendu Samanta, J.)
