Mr. Mit Guha Roy Ms. Sneha Saha Mr. Sayan Sarkar ...for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the petitioner's application filed under Section 144 of the BNSS seeking interim maintenance allowance in connection with the Maintenance case no. 287 of 2025.

Being aggrieved by the inordinate delay in disposing said application, learned counsel for the petitioner submits that the prayer for an interim maintenance application was filed by the hapless lady on 19th April, 2025 but till today, the application has not yet been disposed of and for which she is under threat of starvation. Therefore, the petitioner has prayed for a direction upon the court below for expeditious disposal of the aforesaid interim maintenance application.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

In view of the aforesaid facts and circumstances of this case and that the prayer made by the petitioner is justified and required to be allowed for the ends of justice, the instant application being CRR 331 of 2026 is hereby disposed of with a direction upon the court below to dispose of the interim maintenance application dated 19.4.2025 filed by the petitioner/wife preferably within a period of 30 days from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
