Petitioner complains that, the private respondent is guilty of making construction in deviation to the sanctioned plan. The Municipality is not taking any steps on the complaints lodged.

Learned advocate for the Municipality submits on instruction that, the Municipality inspected the locale and did not find anything untoward. Municipality issued 'completion certificate'. However, there is an issue with regard to a drain, which the Municipality is looking into.

Be that as it may, since, a representation dated September 6, 2019 made by the petitioner is yet to be considered and decided by the Municipality, it would be appropriate to request the respondent no. 4 to consider and decide such representation, in accordance with law, as

expeditiously as possible and preferably within a period of six weeks from the date of communication of this order. The respondent no. 4 will afford an opportunity of hearing to the petitioner and the private respondent. The respondent no. 4 is at liberty to hear such other parties and consult such documents that it deems necessary. The respondent no. 4 will communicate its reasoned order to the parties it had heard forthwith thereafter.

W.P.A. 880 of 2020 is disposed of without any order as to costs.
