Affidavit of service filed on behalf of the petitioner be kept with the record.
The petitioner alleges that he is being restrained by the private respondents from peaceful enjoying his property and to that effect he has informed the police authorities. However, the police authorities did not respond to the information furnished.
Learned advocate for the private respondents submits that they have also right over the property and there is no question of encroachment.
Learned advocate for the State has submitted a report. The report reflects that there is dispute between the parties and hot altercation often takes place as well as each of the parties threatened each other. To that effect, the police authorities have drawn up proceedings under Section 126 BNSS.
So far as the right, title, interest, ownership, possession are concerned, it is the civil court who will decide the same. This Court will not enter into the said domain.
Having regard to the strained relationship between the parties, I direct the police authorities would continue to keep strict vigil and ensure that no breach of peace and tranquility takes place or any untoward incident results because of the inimical relationship existing between the parties.
With the aforesaid observations, WPA 1779 of 2025 is disposed of.
The report, so submitted by the learned advocate for the State, be kept with the record and the same be handed over to the learned advocate for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
