CAN 1 of 2025 Affidavit-of-service filed on behalf of the applicants is taken on record.
Application being CAN 1 of 2025 is for modification of the order dated 21st April, 2025 passed by this Court on the connected writ petition. While disposing of the writ petition by passing order dated 21st April, 2025, Headmaster of Mandar High School (H.S.), Purba Medinipur was directed to issue 'No Objection' certificate in favour of applicant no.1 within a specified time to facilitate applicants' mutual transfer. It is submitted on behalf of the applicants that aforesaid school authority has issued 'No Objection' but thereafter concerned authority of the West Bengal Central School Service Commission has not taken steps for mutual transfer of the applicants and prayer has been made to modify order dated 21st April, 2025 in order to give further direction upon the concerned
authority of the Commission to take steps for mutual transfer.
West Bengal Central School Service Commission and West Bengal Board of Secondary Education are represented by learned advocates.
On perusal of the order dated 21st April, 2025, it appears that the writ petition was disposed of by giving direction upon the Headmaster of Mandar High School (H.S.), Purba Medinipur to issue 'No Objection' certificate in favour of applicant no.1. At the material point of time when the matter was considered by this Court, it was not found that further direction was required to be given upon the concerned authority of the Commission for taking decision on mutual transfer of the applicants. However, if steps are not taken by the Commission, leave is granted to the applicants to take steps, in accordance with law, for consideration of their mutual transfer application.
The application being CAN 1 of 2025 stands disposed.
