On perusal of the report it appears letter was issued by the School Education Department, Government of West Bengal vide Memo No. 271SE (Law)/SL/5S-139/2025 dated 2nd May, 2025 addressed to the Commissioner of School Education, West Bengal whereby it was intimated that School Education Department sought views of West Bengal Central School Service Commission being the Nodal Agency for conducting Upper Primary TET in terms of the
order dated 13th February, 2025 passed by this Court. From the said memo dated 2nd May, 2025 it further appears vide letter dated 30th April, West Bengal Central School Service Commission informed School Education Department that it is under obligation to initiate and complete the recruitment process for Assistant Teacher for classes IX & X and XI & XII and non teaching staff (Group-C and Group-D) which would mandatorily commence on and from 31st May, 2025 and would end around December, 2025 in compliance with the order of the Hon'ble Supreme Court dated 17th April, 2025. But School Service Commission proposed that TET for Upper Primary Level of Classes may be held in March, 2026. Based on such view expressed by the West Bengal Central School Service Commission vide letter dated 30th April, 2025 School Education Department endorsed the proposal of the School Service Commission for conducting TET in March, 2026.
In view of statements made in paragraph 7 of the report filed today and memo dated 2nd May, 2025 issued by the Secretary to the Government of West Bengal addressed to the Commissioner of School Education, West Bengal this Court expects that TET for Upper Primary Level of
Classes will be held in the month of March, 2026. In the event steps are not taken for holding TET in March, 2026 petitioners shall be at liberty to take steps in accordance with law.
Writ petition stands disposed of.
