And In Re : Nejarul Sardar @ Nijarul Petitioner Ms. Minoti Gomes For the Petitioner Mr. Binay Panda, Mr. Subham Bhakat For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Raninagar Police Station Case No.48 of 2019 dated 21.01.2019 under sections 21C/29 of the Narcotic Drugs and Psychotropic Substances Act.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that contraband substance above commercial quantity was recovered from the possession of the petitioner and as such the statutory restrictions are attracted. In view thereof, we are not inclined to exercise any discretion in favour of the petitioner and his prayer for bail is refused at this stage. Ms. Gomes, learned advocate appearing for the petitioner however prays for issuance of necessary direction to expedite the trial.

Answering our query Mr. Panda, learned advocate appearing for the State submits that charges have already been framed and dates

have been fixed on 11th March, 2022, 14th March, 2022 and 15th March, 2022 for evidence.

In view thereof, this Court directs the learned Court below to expeditiously conduct the trial and if necessary, upon resorting to steps available under Section 309 of the Code so that logical conclusion of the case may be reached at the earliest preferably within a period of eight months from the date of the communication of this Court.

The application for bail, being CRM (NDPS) No.129 of 2022, is disposed of.
