Mallik ... for the respondent no. 6 On the earlier date, a report has been submitted by the Officer-in-charge of Chanditala Police Station, which encloses photographs of the area which is the subject-matter as referred to in the writ petition.

The prayers in the writ petition are primarily in respect of soil excavation which has been carried out at the land/property concerned.

The further grievance was that the private respondents

are trying to change the nature and character of the said property.

From the notices issued in connection with Chanditala P.S. Case No.

421 of 2024 it reflects that there certain factual foundations has been unearthed in course of investigation of the said case.

The police authorities are carrying out the investigation. However, they could not trace out the JCB which is one of the allegations regarding the excavation of the soil.

Since the investigation is being carried out, let the same be taken to its logical conclusion within a reasonable period of time.

However, I direct that the police authorities would ensure that without any order from an appropriate authority and/or a court of law, the nature and character of the property referred to in the writ petition should not be altered.

The police authorities would also ensure that no breach of the peace and/or tranquility takes place as also no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 1818 of 2025 is disposed of.

Pending application(s), is any, is also disposed of.

Report so submitted be kept with the record. Copy of the report submitted earlier be given to the petitioner.
