Kausik (Rejected) CRM (NDPS) 175 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Raninagar Police Station Case No. 484/2021 dated 20.11.2021 under Sections 21(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 86 days and he has surrendered before the Court.

Learned advocate for the State submits that the case was registered in the year 2021 and the petitioner having evaded the process of law is not entitled to the relief. The prayer for anticipatory bail was rejected.

Having considered the totality of the circumstances particularly when 184 bottles of Phensedyl were recovered and the petitioner was not available before a Court of law, I direct the petitioner to approach this Court after 6 months.

In the meantime, State would put in efforts to conclude at least 6 witnesses.

At this stage, CRM (NDPS) 175 of 2026 is dismissed. No unnecessary adjournment be given to any of the parties and the trial of the case would continue inspite of any resolution taken by the local bar.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
