01.02.2023 sdas rejected C.R.M.(NDPS) No. 107 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NDPS Case No. 127 of 2019 corresponding to NCB Crime No. 07 of 2019 under Section 22C of the NDPS Act.

And In Re : Samir Mandal alias Satyajit Mandal ..... petitioner Mr. Angshuman Chakraborty ... for the petitioner Mr. Dipankar Dandapath .... for the NCB Learned Counsel for the petitioner submits he is in custody for more than three years. He prays for bail. Learned Counsel for the NCB submits report.

From the report it appears two out of five witnesses have already been examined. Date for examination of the remaining witnesses is fixed in March, 2023. There are materials connecting the petitioner with the alleged crime. On the point of delay we notice trial has progressed and two out of five witnesses have already been examined.

Under such circumstances, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected. Trial court is directed to expedite the trial and conclude the same as expeditiously as possible preferably within six months from the next date fixed for recording evidence without

granting unnecessary adjournments to either of the parties. Parties shall co-operate with the trial.
