1. Heard the learned Counsel for the appellant as well as the learned State Counsel appearing on behalf of the respondents.

2. Learned Counsel for the appellant submits that during the pendency of this appeal, the Government of West Bengal, Transport Department has issued a notification No.

1390-WT/3M-01/2010 dated 10th April, 2017 by which the restriction that was imposed by the notification dated 11.05.2012 has been removed. He also submits that the said notification dated 10.04.2017 has been

notified in The Kolkata Gazette on 18th April, 2017. He, therefore, submits that nothing survives in the present appeal.

3. Recording the submission made by the learned Counsel for the appellant, this appeal is accordingly closed. Further in view of notification dated 10.04.2017 the order dated 02.04.2014 passed by the learned Single Judge in W.P. 37878(W) of 2013 has lost its force. Accordingly FMA 1270 of 2015 along with all connected applications stands disposed of.

The Notification No.1390WT/3M-01/2010-10th April, 2017 is placed on record.

4. No order as to costs.

5. All parties shall act on the Server Copy of this order duly downloaded from the Official Website of this Court.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
