The petitioner was appointed as a casual staff for the post of Laboratory Attendant at the Serampore Girls College in the year 1997. His appointment was duly approved on 07.02.1997. In terms of an order passed by this Court on 27.01.2017, the College Authority allowed the petitioner to participate in the selection process for the post of Laboratory Attendant by relaxing the age bar followed by appointment to the substantive post by appointment letter dated 30.05.2017. The petitioner joined the same post on 1st June, 2017 and is serving there. The petitioner is to retire from the post on 31.03.2025. The petitioner prays that as per law, the past service of the petitioner as "Group-D" Laboratory Attendant at the College should be counted for

disbursement of pensionary benefit. Accordingly, he made a representation before the concerned authority on 31.12.2024. The same has not been responded to as yet. Learned counsel appearing on behalf of the State denies the allegations and submits as follows. The petitioner has not yet retired. So, the application is premature. However, if this Court directs the authorities to consider the representation, the same has to be done by the DPI. It appears that the petitioner's superannuation is nearing. It further appears that a representation of the petitioner dated 31.12.2024 is pending consideration before the authorities.

In view of the above, let the DPI consider the petitioner's representation dated 31.12.2024 in accordance with law and upon hearing the petitioner in this regard as expeditiously as possible.

It is made clear that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of.
