The petitioner is granted liberty to challenge the proceedings being Misc. Case No. 314 of 2021 before the learned Sessions Judge, Howrah under Section 29 of the Protection of Women from Domestic Violence Act. Learned advocate appearing for the petitioner has questioned the continuance of the proceedings as there were applications filed earlier which are pending before the court and there are affidavits for being considered. Accordingly, the petitioner would be at liberty to canvass all the points before the learned appellate court. The learned appellate court will independently deal with the issues so concerned without being influenced by any observations made by this Court. In case there is delay in preferring the appeal, the learned appellate court will take into account the period of pendency of the revisional application before this Court.

With the aforesaid observations, the revisional application being CRR 331 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

The petitioner is granted liberty to take back the certified copy from the department after the same being replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
