Subject to such undertaking, the writ petition is taken up for hearing through video conference.

The Tribunal has now been functioning properly. The record of the learned Tribunal shows that the Tribunal was unable to proceed with the original application filed by the writ petitioner due to absence of Mr. A. L. Basu, learned counsel representing the State respondents. The repeated absence of the State

respondents have been seriously viewed by the learned Tribunal.

It appears from the order dated 26th August, 2020 that the learned Tribunal has fixed the matter on 18th November, 2020.

We request the learned Tribunal to dispose of the original application as expeditiously as possible and, in the event, the State respondents are not represented on 18th November, 2020, learned Tribunal may decide the original application being, OA of 2017, in accordance with law and on merits on the basis of the available records.

The writ petitioner shall communicate this order to the office of the learned Advocate General for information and taking necessary action.

An appropriate notice shall also be served upon Mr. S. Bhattacharya, junior to learned senior counsel, Mr. A.L. Basu.

The writ petition as well as the connected application are disposed of.

There shall, however, be no order as to costs.
