Mr. Manik Lal Poddar ....for the Petitioner The learned advocate appearing for the petitioner submits that the Misc. Appeal being No. 21 of 2024 is pending before the learned Additional Sessions Judge, Fast Track Court - II, Sealdah from November, 2024. He submits that the application under Section 5 of the Limitation Act is yet to be disposed of.

The learned advocate appearing for the petitioner submits that June 23, 2025 has been fixed for hearing of the application under Section 5 of the Limitation Act.

The learned advocate appearing for the petitioner further submits that the opposite parties herein have appeared in the Misc. Appeal but have not yet filed the written objection.

If the written objection to the Section 5 application is not filed on or before the next date of hearing, the learned Additional Sessions Judge, Fast Track Court - II, Sealdah shall take up the hearing of the Section 5 application on the next date fixed, that is on June 23, 2025 and dispose of the same as expeditiously as possible without granting unnecessary adjournments to either of the parties.

Depending on the fate of the application under Section 5 of the Limitation Act, the learned Judge of the First Appellate Court shall proceed with the hearing of the appeal in accordance with law.

With the above observations and directions CO 260 of 2025 stands disposed of.

Petitioner shall be obliged to forward a copy of this application along with this order to the opposite party or the learned advocate for the opposite party representing him before the learned First Appellate Court.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
