C.R.R. 290 of 2022 Court No.

Item 30 Ssi In the matter of:- Basanti Dalui 07.02.

(via video conference) Mr. Pratip Kumar Chatterjee ...for the petitioner Ms. Ayantika Roy ....for the State This is an application seeking expeditious disposal of a proceeding in which a charge-sheet was submitted under Section 302 read with Section 34 of the Indian Penal Code.

Let a copy of this application be served upon Ms. Ayantika Roy, learned advocate, who is present in Court today and who ordinarily appears on behalf of the State. Her engagement may be regularised in due course by the competent authority of the State.

Learned counsel for the petitioner submits as follows. The petitioner is the defacto-complainant and the mother of the victim deceased in this case. The incident took place in 2019. The petitioner lodged the First Information Report on 23.03.2019.

After completion of investigation, charge-sheet was submitted in 2019 itself . However, till date the matter could not even be committed to the Session Court. The matter has remained pending for no fault of the present petitioner. Learned counsel appearing on behalf of the State

submits that the State would not come in the way if a direction is passed to expedite the proceeding. I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It appears that despite passage of considerable time, the matter could not be committed to the Sessions.

Some delay has clearly been occasioned in concluding the proceeding.

In view of the same and in the interest of justice, I request the learned Committal Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and in particular, to conclude the proceeding for commitment of the case at the earliest, preferably within a period of three months from the next date of hearing.

With these observations, the revisional application is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
