The pleadings in the writ petition are totally contradictory to the facts narrated in the representation filed by the petitioner no. 1. Although the petitioners allege that the respondent nos. 8 and 9 had raised an unauthorized construction in front of L.R. Plot No. 1474/2440, in the representation filed before the gram panchayat, the petitioner no. 1 had narrated a completely different set of facts. They contended that the respondent nos. 8 and 9 had constructed on a Nayanjuli over PWD land. On such defective pleadings and averments, the writ petition cannot be entertained.

The writ petition is disposed of without any orders.

If in future the petitioners have further grievance, the petitioners may approach the

authority with proper pleadings and specifications with regard to their objections insofar as the construction by the respondent nos. 8 and 9 is concerned. Stray and omnibus allegations shall not be entertained.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
