The grievance of the petitioner is that he alone is facing the trial and has been attending the court continuously and, there has been no progress of the case since the year 2018.
It has been submitted before this court that the execution of warrant in respect of the another accused person is pending. The order sheet so produced do not make it transparent whether proclamation and attachment has been issued against the said accused person or not. Having regard to the period of pendency and nonparticipation in respect of the other accused, I am of the view that the ld. JM, 3rd Court, Barrackpore would exhaust
all the harsher process of law for compelling the appearance of the accused and thereafter split up the trial of the case. The ld. Magistrate would fix at least one date in a month for the purpose of the present case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
The inspector in charge of Bizpur P.S. may be informed if the witnesses do not appear before the court, in that case, from the next date steps are to be taken by the inspector in charge of Bizpur P.S. for ensuring appearance of the witnesses or, in the alternative, a report be submitted regarding the non-availability of the witnesses concerned. Ld. Public Prosecutor conducting the case will produce the materials, exhibits and documents on the next date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. Trial court so that the trial is concluded at the earliest.
With the aforesaid observations CRR 333 of 2024 is disposed of.
Pending application, if any, is also disposed of. Report so submitted be kept with the record.
