The genesis of the dispute arose because of land dispute, consequent to which Raiganj P.S. Case No.656 of 2024 dated 05.07.2024 was registered for investigation and the present petitioner along with others were implicated as accused in the said case. The said investigation has been concluded and charge-sheet has been submitted. However, the grievance of the petitioner is that the petitioner and his family members also sustained injuries and to that effect informed to the local police station but no steps were taken by the local police station. Consequent to which petitioner submits that there has been an unilateral investigation without the truth being unearthed.
A report has been submitted by the State.
State has taken a plea that the petitioner and his
family members were not available. However, having regard to the injury report which has been produced before this Court and as also enclosed, the police authorities are ready and willing to start a specific case.
Having regard to the same, I direct the petitioner to approach the police authorities, police authorities if they find that a cognizable offence is made out, they would proceed in accordance with law.
With the aforesaid observations, WPA 1871 of 2025 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
