Learned advocate appearing for the petitioner submits that petitioner is in custody for 11 months and out of 22 witnesses one witness has been examined being the victim girl. Learned advocate submits that the petitioner may be released on bail on any stringent conditions as there is no possibility of the trial concluding in near future.
Learned advocate for the State has produced the Case Diary. I have taken into account the statement of the victim under Section 164 of the Code of Criminal Procedure as well as the statement of the doctor who opined that the minor victim became pregnant as a consequence of sexual assault inflicted by the accused/petitioner.
Having considered the same, I am not inclined to release the petitioner on bail.
As such the prayer for bail of the petitioner in CRM (M) 250 of 2026 is dismissed.
Learned trial Court is directed to expedite the process of trial considering the number of witnesses left.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
