Hossain, learned advocate appears Court No. 22 17.6.2022 (Item No. 60) (AB) for the petitioner prays for leave to implead the new incumbent as an alleged contemnor in this proceeding. Such leave is granted.
The petitioner shall serve a copy of this contempt application upon the new incumbent and shall file an affidavit of service on the adjourned date. Mr. Vaisya, learned counsel appearing with Mr. Gourav Das, learned advocate appearing for the alleged first contemnor submits that, his client has complied the order way back on February 2, 2016. It is submitted on behalf of the parties that arising out of the same order wherefrom this contempt proceeding was carried out, an appeal is pending being MAT 454 of 2016.
The learned counsel for the petitioner submits that by an order dated December 15, 2017 the stay granted in the said appeal stood vacated. So there is
no impediment in proceeding with the present contempt proceeding.
After hearing the submissions made on behalf of the parties and on perusal of the record, it appears to this Court, that the judicial propriety demands disposal of the said appeal before taking up the said contempt proceeding.
In view of the above, the said contempt application is directed to go out of list for the time being with liberty to mention.
