Kausik (Rejected) CRM (M) 286 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabadwip Police Station Case No. 589 of 2025 dated 08.08.2025 under Section 118(2)/351(2)/65(1)/74/3(5) of the BNS, 2023 and Section 6 of the POCSO Act, 2012.

Report submitted by the State reflecting service upon the defacto complainant be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 148 days and charge sheet has already been submitted. It has also been submitted that there was a relationship between the petitioner and the victim and on the point of disagreement at a subsequent stage, the present case has been designed to frame the present petitioner. On any stringent condition, petitioner has prayed for bail. Learned advocate for the State has produced the case diary.

I have considered the statement of the victim, the medical documents and the stage of the case.

Having considered the merits of the case, I am of the opinion that petitioner would be at liberty to pray for bail before the learned Special Court after the evidence of the victim is over. To that effect, I direct that on the next date fixed, learned Trial Court would overcome the stage of consideration of charges and within a period of 15 days commence the evidence of the victim.

With the aforesaid observations CRM(M) 286 of 2026 is dismissed at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
