Petitioners earlier approached this Court when in WPA 13259 of 2022 a co-ordinate Bench was pleased to direct the petitioners to ascertain regarding the measurement of the land by approaching the appropriate authorities. Petitioners have now come up before this Court that they are being obstructed by the private respondents for measuring their land. State has submitted a report. Report reflects that a long standing dispute is existing between the petitioners and the private respondent nos.8 to 12. Learned advocate for the respondent nos.8 to 12 opposes the contentions as the petitioners have

not complied the mode and manner in which the order was earlier passed in WPA 13259 of 2022. In view of the directions already passed in the earlier writ petition by a co-ordinate Bench of this Court, petitioners would approach the concerned authorities referred to there in the order being the Pradhan of Gram Panchayat and the BDO, Khejuri-I. In view of the directions having been passed by the co-ordinate Bench, if the petitioners approach the concerned authorities, the concerned authorities would take their independent decision for redressing the grievance of the petitioners. In the meantime, the police authorities would ensure that they would keep a strict vigil and see to that no breach of the peace and/or tranquility takes place or any untoward incident results because of the strained relationship already existing between the parties.

With the aforesaid observations, WPA 1878 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
