Affidavit-of-service filed by the petitioners be kept with the record.

Petitioners complain that they are being disturbed in respect of possession of their property at the behest of the private respondents.

State has submitted a report. Report reflects that already the police authorities have drawn up proceedings under Section 126 of the BNSS.

Learned advocate for the private respondent nos.7 and 8 opposes the contentions of the petitioners so far as their claim in the writ petition is concerned.

I find that there is a dispute between the petitioners and the private respondents in respect of the property-in-issue. The right, title, interest and demarcation of the property is absolutely the domain of the civil court. So far as the other issues are concerned, the police authorities would keep a strict vigil so that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the strained relationship already existing between the parties.

With the aforesaid observations, WPA 1880 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
