Abhik Mallick And ORS. v. State Of West Bengal And ORS.
ss/jks 06.02.2023 WPA(P) 25 of 2023 Abhik Mallick & Ors.
Vs.
The State of West Bengal & Ors.
Mr. Supratik Basu Mr. Shuvam Shaw ... ... for the petitioners Mr. Amitesh Banerjee, Sr. Adv.
Ms. Ipsita Banerjee Mr. Suddhadev Adak ... ... for the State The allegation in the petition is that one person named in the petition projecting herself to be astrologer along with her husband has deceived the petitioners. We find substance in the preliminary objection of learned counsel for the State that for such a personal cause public interest petition cannot be maintained and that the petitioners have the remedy of approaching the police and in case of police inaction they have a separate remedy of filing a writ petition before the learned Single Judge.
In view of this, learned counsel for the petitioners seeks permission to withdraw the PIL with liberty to avail such other remedies as are available in law.
The prayer is allowed.
This public interest petition is dismissed as withdrawn with the liberty as prayed.
