The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Pandua Police Station Case No. 35 of 2012 under Section 392 of the Indian Penal Code and Sections 25/27 of the Arms Act.

Pursuant to the order dated 15th March, 2021 the Officer-inCharge of Pandua police station has submitted the report. Let the same be taken on record.

After perusing the said report we find that substantial progress has already been made in the trial. Fifteen witnesses have already been examined and the schedule for recording statements of the witnesses has been fixed on and from 12th April, 2021. We do not find any material warranting any lenient view to be taken in this regard at this stage. Accordingly, the prayer for bail is rejected.

The case has seen substantial progress. However, we appreciate the agony and anguish shown by the learned Advocate for the petitioner over the delayed trial. Though we reject the application

for bail at this stage, but we feel that the Sessions Judge should take utmost effort to expedite the case and shall bring to its logical end within six months from the date of the communication of this order. The application for bail, being CRM 784 of 2021, is thus dismissed.
