Basanta Kumar Manna v. State Of West Bengal & ANR

20.6.2022 AB Ct. No.6 CRR 92 of 2010 + IA No. CRAN 1 of 2010 (Old No. CRAN 167 of 2010) In Re : Basanta Kumar Manna None appears today even on the second call either on behalf of the petitioner or on behalf of the opposite parties. Record reveals that previously on 09.6.2022, 10.6.2022 and 16.6.2022 no one appeared in the matter when the matter was called on for hearing. Hence, the case record is taken up for delivering the order in absence of the parties.

This revision application has been filed by the petitioner in the year 2010. On perusal of the records it appears that in this revision case the judgment and order dated 09.9.2009 passed by the learned Additional Chief Judicial Magistrate, Kakdwip, 24 Parganas (South) in case No.M- 241 of 2007 has been challenged by dint of which the Court directed the present petitioner to pay a maintenance to the opposite party No. 2 to the tune of Rs.1,000/- per month for herself and Rs.500/- per month each for the two minor children of the parties. The petitioner has sought to espouse jurisdiction under Section 482 of the Cr.P.C., 1973 by filing the instant revision case, to challenge the said order.

On perusal of the records I am of the opinion that the grounds as made out in this case would not be enough to satisfy this Court to interfere into the impugned order passed by the Court below as challenged in this revision petition.

On the finding as above, I am inclined to dismiss the revision case being CRR 92 of 2010. Interim order, if any, stands vacated. Connected application, if any, stands adjudicated with the case. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
