Mr. Imran Ali Mrs. Sujata Das .....for the State This is an application challenging the issuance of warrant of arrest against the petitioners in a case where a charge sheet was submitted under Sections 307, 325, 354A, 406, 498A and 506 of the Penal Code.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. The FIR was lodged in 2015. The petitioners surrendered before the learned trial court on 23.07.2015 and were granted bail. Subsequently, a charge sheet was submitted. The petitioners regularly attended the Court. On 19.06.2020 during the lockdown period, the petitioners could not attend the Court or take steps. Accordingly, warrant of arrest was issued against them which remain pending. The petitioners want to join the proceeding at the earliest. Learned counsel on behalf of the State submits that the petitioners may be directed to surrender before the learned trial court at the earliest.

I have heard submissions of the learned counsels

appearing on behalf of the petitioners and the State and have perused the revision petition.

It appears that for quite a long period, the petitioners were attending the Court. At present the petitioners want to join the proceeding at the earliest.

In view of the above, let the warrant of arrest issued against the petitioners shall remain stayed for a period of four weeks from this date. The petitioners shall surrender before the learned trial court within the said period of four weeks from this date. In the event the petitioners surrenders before the learned trial court within such time and pray for bail, then application for bail shall be considered in accordance with law.

With these observations, the revisional application is disposed of Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
