It is submitted by the learned counsel appearing on behalf of the appellant that the Insurance Company does not intend to proceed further with the case and the statutory deposit as made before this court may be withdrawn.
It appears that the instant appeal is filed challenging the impugned Judgement and Award passed by the learned Tribunal in connection with MACC Case No.
of 2014(N).
By passing the impugned judgement, learned Tribunal awarded the compensation in favour of the claimants/respondents to the tune of Rs.4,84,700/-.
Being aggrieved by and dissatisfied with the said impugned judgement, the instant appeal has been preferred on behalf of the Insurance Company. Now the appellant does not intend to proceed further with the present appeal. Accordingly, the present
appeal being FMA 3016 of 2016 is hereby dismissed for non-prosecution.
As per report submitted by the Addl. Stamp Reporter dated 10-07-2015, a statutory deposit of Rs.25,000/- was made before the office.
Liberty is hereby given to the appellant to withdraw the statutory deposit with accrued interest thereon as made before the office of this Court within two weeks from date.
Ld. Registrar General is directed to release the said statutory deposit along with accrued interest thereon in favour of this appellant/National Insurance Co. Ltd. (Prasenjit Biswas, J. )
