Mr. Somnath Adhikary ... For the Petitioner Mr. Bidyut Kumar Roy Ms. Rita Datta ... For the State Learned advocate for the petitioner submits that the defacto-complainant has belatedly approached the court and the petitioner happens to be the bonafide owner of the property. He further submits that even if the allegations are accepted to be true, there is no need for detention of custodial interrogation of the present petitioner. The learned advocate appearing for the State opposes the prayer for anticipatory bail and draws the attention of this Court to the statements of the witnesses as also the documents, which have been collected by the Investigating Officer in course of investigation.

We have perused the materials in the case diary and we find that the investigation is in progress and, prima facie, there are ingredient materials against the present petitioner, who happens to be the beneficiary of the forged document. Having regard to the nature and gravity of the offence, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.

Accordingly, the application for anticipatory bail is rejected.

CRM 790 of 2021 is thus disposed of.
